Costs - Employers
We believe in access to justice and no nasty cost surprises. Because of this, we can usually offer fixed rate representation for employers for employment advice, employment meetings, mediations, representation at the Employment Relations Authority and at the Employment Court.
There are many benefits to you of a fixed rate fee: the overall cost is likely to be less than you would pay if you were billed on an hourly basis, you will know exactly what your costs are and you will know that they are fair.

Advice of a One Off Nature: We charge a flat rate fixed fee for email and telephone advice (up to approximately an hour of our time). In most cases we can respond in full within 24-48 hours of payment of our fee. We can advsie you on any employment related issue. Examples of situations where this advice will be useful include:
Employment Meeting/Disciplinary Meeting: Our flat fixed rate fee includes: drafting the letters required prior to the meeting, travel within Auckland, preparation, meeting with you prior to the meeting, attendance at the meeting (no matter how long it lasts), GST, and any incidental matters afterwards. We are available to attend meetings after hours - in the evenings or on weekends. Please ask for a quote if you need help outside the Auckland area.
Employment Mediations: Our fixed rates for employment mediations are usually $1,000 - $2,000. The cost includes travel within Auckland, meeting with you before the mediation, dealing with the employee and the mediation service in the period leading up to the mediation, preparation for the mediation, attendance at the mediation (no matter how long it lasts), GST, and any incidental matters afterwards.

We are Auckland based; however, we are able to attend mediations and hearings anywhere in New Zealand. Because we will negotiate a fixed rate with you, even for mediations and hearings outside of Auckland, having us attend with you is often more cost effective than using someone local.

- You have received an employment claim from an employee or former employee: We will assess the claim and advise you on the best strategy, the likely outcome and the pros and cons of the various options for resolving the case.
- Your ex employee is setting up in opposition to you in breach of a restraint of trade clause: We will advise you on the strength of your clause and the options for dealing with the situation.
- You have performance or other concerns about an employee: We will advise you on whether your concerns are legally enough to take action against the employee, what kind of action you can take and indicate the correct procedure.
- You have an employee within the 90 day trial period and you need to dismiss them: We will advise you on how to do this so that you minimise the risk of a claim against you (although 90 day trial periods are supposed to protect employers against claims for unjustified dismissals some 90 days clauses are badly worded and ineffective, and employees have other rights to take action against you if the dismissal is handled wrongly).
- Advice on helping an employee to exit.
- You have agreed a settlement with an employee or an ex employee and you need to know how to make the settlement binding so that you are protected.
- Advice on what level of settlement offer you should make.
- You entered into a binding settlement with an employee and they have beached the terms of the settlement. We can advise you on your options and the pros and cons of the various options.
